SPECIAL POWER OF ATTORNEY

(to sign a Contract of Lease — principal abroad)

KNOW ALL PERSONS BY THESE PRESENTS:

I, [FULL NAME OF PRINCIPAL], of legal age, [CIVIL STATUS], [CITIZENSHIP], Philippine passport / ID No. [NUMBER], with Philippine address at [PHILIPPINE ADDRESS], and presently residing at [FOREIGN ADDRESS], [COUNTRY] (the "Principal"), do hereby name, constitute and appoint [FULL NAME OF REPRESENTATIVE], of legal age, [CIVIL STATUS], [CITIZENSHIP], with residence at [ADDRESS IN THE PHILIPPINES], [RELATIONSHIP TO PRINCIPAL, IF ANY] (the "Representative"), to be my true and lawful attorney-in-fact, for me and in my name, place and stead, to do the following specific acts:

1. To lease, as [LESSOR/LESSEE], the property located at [COMPLETE ADDRESS OF THE PROPERTY] [covered by Transfer Certificate of Title / Condominium Certificate of Title No. [NUMBER] of the Registry of Deeds of [CITY/PROVINCE]], to/from [FULL NAME OF THE OTHER PARTY], for a term of [TERM, e.g., TWELVE (12) MONTHS] beginning [START DATE], at a monthly rent of not less than / not more than [AMOUNT IN WORDS] PESOS (PHP [AMOUNT]), with a security deposit of [AMOUNT] and advance rent of [AMOUNT];

2. To sign, in my name, the Contract of Lease on the above terms and any renewal on the same terms, and to sign it either on paper or electronically, together with its annexes, inventory and receipts;

3. To appear before a notary public in the Philippines and acknowledge the Contract of Lease as my free and voluntary act;

4. [IF LESSOR] To receive the advance rent, the security deposit and the monthly rent, to issue receipts for them, and to deposit them to my account No. [ACCOUNT] with [BANK];

5. [IF LESSOR] To deliver the keys and the property, to sign the inventory and move-in report, and, at the end of the lease, to receive the property back and settle the deposit;

6. To do all other acts necessary and incidental to the foregoing, but not to sell, mortgage or otherwise encumber the property.

[Keep only the acts actually granted. A lease of real property for more than one year needs a special power of attorney: Civil Code, Art. 1878 (8). Keep the term, rent and parties specific — a vague SPA is often refused by notaries and registries.]

HEREBY GIVING AND GRANTING to my Representative full power and authority to do every act necessary to carry out the foregoing, as fully as I could do if personally present, and HEREBY RATIFYING AND CONFIRMING all that my Representative shall lawfully do under this instrument. My Representative [MAY/MAY NOT] appoint a substitute. This Special Power of Attorney shall remain in force until [DATE / the end of the lease and the settlement of the deposit], unless I revoke it earlier in writing.

IN WITNESS WHEREOF, I have signed this instrument on [DATE] at [CITY], [COUNTRY].

ACKNOWLEDGMENT

[Choose ONE of the two ways below, depending on the country where the Principal signs. Delete the other.]

A. Country that is a party to the Apostille Convention (for example the United States, Canada, Australia, Japan, Hong Kong, Singapore, Italy, Spain, the United Kingdom, Saudi Arabia since 2022): the Principal signs and acknowledges this SPA before a local notary public of that country, using that notary’s own form of acknowledgment; the competent authority of that country then attaches an apostille. No further authentication by the Philippine Embassy or Consulate is needed (the Philippines joined the Apostille Convention on 14 May 2019).

B. Any other country (for example the United Arab Emirates, Qatar, Kuwait): the Principal personally appears before a Philippine consular officer at the Embassy or Consulate, who notarizes this SPA with the acknowledgment below ("consularized SPA").

HOW THIS SPA IS USED WITH THE LEASE — delete this page before printing

1. Sign the SPA abroad — way A (local notary + apostille) or way B (Philippine Embassy/Consulate). Bring a passport; the consulate usually wants an appointment and the fee in local currency.

2. Send the original to the Representative in the Philippines (courier). A scan is enough to sign electronically, but the notary in the Philippines will ask to see the original apostilled or consularized SPA when the lease is acknowledged.

3. The Representative signs the Contract of Lease "for and on behalf of [FULL NAME OF PRINCIPAL], by virtue of a Special Power of Attorney dated [DATE], [apostilled on [DATE] by [AUTHORITY] / acknowledged before the Philippine Consulate in [CITY] on [DATE]]". Attach a copy of the SPA as an annex to the lease.

4. Notary once: collect all signatures of the lessor, lessee, representative and two witnesses first, then appear before the notary together (or one by one, within the same notarial session where the notary allows it) for a single acknowledgment. Each person brings competent evidence of identity (2004 Rules on Notarial Practice, Rule II, Sec. 12).
