Option 2 — Foreign notary + Apostille (or consular authentication)

1. The principal signs before a notary public of the country where he or she is, who attaches the notarial certificate required by local law. Leave this space for that certificate.

2. If that country is a party to the Apostille Convention (in force for the Philippines since 14 May 2019), the competent authority of that country issues an Apostille on the notarized SPA. No further authentication by the Philippine Embassy/Consulate is needed.

3. If that country is not a party, the notarized SPA must be authenticated by the Philippine Embassy/Consulate having jurisdiction.

4. Send the original (with Apostille or authentication) to the Philippines. Registries of Deeds, banks and the BIR generally require the original, not a scan.

• Basis: Civil Code, Arts. 1868–1932 (agency); Art. 1878 (special power required for acts of strict dominion, compromise, loans, leases of real property over one year, etc.); Art. 1874 (sale of land through an agent is void unless the authority is in writing); Art. 1892 (substitution); Arts. 1919–1920 (revocation).

• Notarial act: acknowledgment (2004 Rules on Notarial Practice, Rule II, Sec. 1). The notary must not notarize if the principal is not physically present (Rule IV, Sec. 2(b)).

• Abroad: consular notarial services of the DFA/Foreign Service Posts, or local notarization plus Apostille (Apostille Convention, Philippines effective 14 May 2019). Check the post’s current requirements and whether the receiving office (RD, bank, BIR) accepts the chosen route.

• Electronic notarization: the Rules on Electronic Notarization (A.M. No. 24-10-14-SC, approved 4 Feb 2025) supplement the 2004 Rules; confirm whether the receiving office accepts e-notarized instruments before using them.

• Banks often refuse general SPAs and require their own forms; ask the bank first.
