Dear Sir or Madam,

Reply under section 172 of the Road Traffic Act 1988

I am the registered keeper of the vehicle above. I have tried to identify who was driving it at the time of the alleged offence, but I do not know and, despite the steps below, I have not been able to find out. I give all the information in my power that may lead to the identification of the driver.

1. People who could have been driving

Name Address Relationship / insured? What they told me, and when

[NAME] [ADDRESS] [FOR EXAMPLE: MY PARTNER, NAMED DRIVER] [SAID THEY DID NOT DRIVE / CANNOT REMEMBER — DATE ASKED]

[NAME] [ADDRESS] [RELATIONSHIP] [ANSWER — DATE ASKED]

[MYSELF] Keeper and main driver [WHERE I WAS AT THAT TIME, IF KNOWN]

2. Steps I took to find out

On [DATE] I asked each person above, [IN PERSON / BY TEXT / BY EMAIL]; copies of the messages are enclosed.

I checked [DIARIES / WORK ROTAS / CALENDAR ENTRIES] for [DATE OF OFFENCE]: [RESULT].

I checked [FUEL RECEIPTS / BANK STATEMENTS / TOLL OR PARKING RECORDS / PHONE LOCATION HISTORY / TELEMATICS]: [RESULT].

[ANY OTHER STEP, WITH DATE AND RESULT].

3. Why I still cannot say who was driving

[EXPLAIN, FOR EXAMPLE: THE CAR IS SHARED BY (NUMBER) INSURED DRIVERS, KEYS ARE KEPT IN THE HALL, THE DAY WAS (DESCRIPTION) AND NO RECORD SHOWS WHO USED IT.]

4. Request

If you have any photograph or video of the driver, please send me a copy so that I can try again to identify the driver. I will write to you immediately if I find out who was driving.

I make this reply to comply with section 172. I rely on section 172(4): I do not know and could not with reasonable diligence have ascertained who the driver was. This reply is not an admission of the alleged offence.

Yours faithfully,
