Quitclaim: Check It Before You Sign
For [Your name], at [Company]: a paper that says you got paid and give up claims. Read it first. A receipt you can use instead is on the next page.
1. What you need
☐ Your notice or letter ending the job, and your last payslip.
☐ The final pay computation, line by line: salary, 13th month pay, leave, separation pay.
☐ The quitclaim itself, with the amount, before you sign.
☐ Your own math: what share of what you are owed does this amount cover?
2. The form
– No special form: who, how much, what you give up, signature. It must be clear to you.
– Read what it covers: money, dismissal, reinstatement, “all claims”. One can cover money only (G.R. 236496).
3. Your application
– The employer must prove four things: you signed voluntarily, no fraud, a credible and reasonable amount, nothing against the law (G.R. 255368, 2024).
– There is no exact percentage. In that case 5.20% to 23.42% of the award was too low.
– Need alone does not cancel a quitclaim if there was no fraud or pressure (G.R. 193484, G.R. 215874). So do not count on undoing it later.
– Ask for time to read it. If the amount is only what you are already owed, offer the receipt on the next page.
– The employer may hold terminal pay until you return company property (G.R. 202961), but still owes it.
4. Where to file
– First SEnA: a Request for Assistance with DOLE, NCMB or NLRC, online or in person.
– Final pay and Certificate of Employment: the DOLE Regional, Provincial or Field Office.
– Dismissal, and money over P5,000: Labor Arbiter, after SEnA.
5. Time limits
– Final pay within 30 days, Certificate of Employment within 3 days (DOLE Labor Advisory 06-20).
– SEnA: 30 calendar days, up to 15 more by agreement.
– Money claims: 3 years (Labor Code, art. 306 [291]). Illegal dismissal: 4 years.
– A written demand interrupts the period (G.R. 185463).
6. Keep it and renew
– Keep the signed paper, the computation, proof of payment and any written demand.
– If a court cancels a quitclaim, what you received is returned or offset (G.R. 215874).
