Dear Sir or Madam,
Section 172 reply and notice of intended prosecution served after 14 days
1. Section 172 reply. I enclose the completed section 172 form [OR: I have completed the online reply, confirmation number (NUMBER)]. In compliance with section 172 of the Road Traffic Act 1988, I have given the driver's details as requested. I do so only to comply with that section.
2. Late notice of intended prosecution. The alleged offence took place on [DATE OF OFFENCE]. The notice of intended prosecution is dated [DATE ON NOTICE] and was received by [ME / THE REGISTERED KEEPER, (NAME)] on [DATE RECEIVED], [NUMBER] days after the alleged offence. [THE ENVELOPE IS POSTMARKED (DATE) / IT WAS SENT BY (SECOND-CLASS POST / EMAIL)].
At the time of the alleged offence the registered keeper of the vehicle was [ME / (NAME OF KEEPER)], at [ADDRESS HELD BY DVLA], which was correct and up to date. No warning was given at the time and no summons has been served.
Section 1(1) of the Road Traffic Offenders Act 1988 provides that a person shall not be convicted of an offence to which that section applies unless a notice of intended prosecution was served on the driver or the registered keeper within fourteen days of the offence, or one of the other conditions in section 1(1) is met. I reserve the right to rely on section 1 in any proceedings. Nothing in this letter or in the section 172 reply is an admission of the alleged offence.
Please acknowledge receipt of this letter and the section 172 reply.
Yours faithfully,
