Name Signature Date

For me: before we sign

[ ] Price of $500 or more: the agreement is in writing and signed, at least by the party it is enforced against (Va. Code 8.2-201; RCW 62A.2-201)

[ ] The horse is identified by registration number, markings, microchip or brand, so there is no doubt which horse is sold

[ ] Section 5 lists every lien, or "none"; the seller warrants title anyway unless clearly excluded (Va. Code 8.2-312)

[ ] "As is" is in capital letters and checked, or the warranties are written out: "as is" or "with all faults" excludes implied warranties, unless the circumstances indicate otherwise (Va. Code 8.2-316(3))

[ ] What the seller said about the horse is written in section 6: a statement of fact that is part of the bargain can be an express warranty (Va. Code 8.2-313)

[ ] Washington: in sales of livestock, including horses, there is no implied warranty against sickness or disease if the seller followed animal health laws and did not mislead (RCW 62A.2-316(3)(d))

[ ] The moment risk passes is written in section 4 (Va. Code 8.2-509(4))

[ ] I checked my state's rules for health tests, health certificates, brand inspection and transport before the horse moves
