Dear [NAME],
Appeal against the refusal of my flexible working request dated [DATE OF REQUEST] — section 80G, Employment Rights Act 1996
I work for you as [JOB TITLE] in [TEAM / SITE], employee number [NUMBER]. On [DATE OF REQUEST] I made a statutory request for flexible working, asking to [DESCRIBE THE CHANGE, FOR EXAMPLE: WORK 4 DAYS A WEEK / WORK FROM HOME ON 2 DAYS / START AT 9:30] from [PROPOSED START DATE]. On [DATE OF REFUSAL] you told me that the request was refused.
I appeal against that decision for the following reasons (tick all that apply):
( ) I was not consulted before the refusal. Section 80G(1)(aza) says an employer must not refuse an application unless the employee has been consulted about it. [DESCRIBE: NO MEETING / A SHORT CONVERSATION THAT DID NOT DISCUSS MY PROPOSAL OR ALTERNATIVES]
( ) The reason given is not one of the grounds in section 80G(1)(b). The refusal said: "[QUOTE THE REASON GIVEN]".
( ) The refusal is based on incorrect facts (section 80H(1)(b)). You said [WHAT THE EMPLOYER SAID]. In fact [THE CORRECT FACTS, WITH EXAMPLES: COVER ALREADY ARRANGED, SIMILAR PATTERN WORKING FOR COLLEAGUES, WORKLOAD FIGURES].
( ) The request was not dealt with in a reasonable manner (section 80G(1)(a)). [DETAILS]
( ) The decision came after the decision period. The 2-month period began on [DATE OF REQUEST] and ended on [DATE], and no extension was agreed (section 80G(1B)).
My proposal. To meet the concern you raised, I suggest [ALTERNATIVE PATTERN / TRIAL PERIOD OF (NUMBER) WEEKS WITH A REVIEW ON (DATE) / OTHER ADJUSTMENT]. I am happy to discuss other options.
Please arrange an appeal meeting with someone not involved in the first decision, if possible, and send me your final decision in writing. Under section 80G(1A) and (1B), the decision on this appeal is due within the decision period, which ends on [END OF DECISION PERIOD], unless we agree a longer period in writing.
I would be grateful for a reply by [DATE].
Yours sincerely,

For me
[ ] Decision period: 2 months from my request — ends [DATE]; any extension agreed in writing
[ ] If no final decision by then, or the decision broke section 80G: contact Acas for early conciliation first
[ ] Tribunal time limit: 6 months from the final decision or the end of the decision period — [DATE]
[ ] From October 2027 (GOV.UK timeline): a refusal must also be reasonable and explained — check the rules again if I apply after that
