• Basis: Civil Code, Arts. 1458 (sale), 1495–1501 (delivery), 1547–1548 (warranty of title and against eviction), 1561 (hidden defects); R.A. No. 4136 (Land Transportation and Traffic Code) on registration and transfer; Act No. 1508 (Chattel Mortgage Law) if the Vehicle is mortgaged.
• Registered-owner rule: the registered owner remains answerable to third persons until the transfer is recorded with LTO (e.g., Filcar Transport Services v. Espinas, G.R. No. 174156, 20 June 2012). Avoid "open" deeds; insist on prompt transfer.
• LTO requirements and deadlines for reporting the sale and transferring registration change; secondary sources report LTO rules issued in 2024 with fines for late reporting/transfer. Confirm the current LTO issuance and Citizen’s Charter (original CR/OR, PNP-HPG clearance, MVIR, CTPL insurance, IDs) before execution.
• If financed: obtain the bank’s release of chattel mortgage and its annotation before sale.
• Notarial act: acknowledgment (2004 Rules, Rule II, Sec. 1). All signatories must appear personally.
