Notice under section 16(4) of the Local Government Finance Act 1992 — removal of single person discount

Dear Sir or Madam,

By your [LETTER / REVISED BILL] dated [DATE OF THE COUNCIL'S DECISION], you removed the 25% single person discount from my account with effect from [DATE FROM WHICH IT WAS REMOVED]. I am aggrieved by your calculation of the amount I must pay, and this letter is my written notice under section 16(4) of the Act.

1. The matter

You have decided that [NAME OF THE OTHER PERSON, OR "ANOTHER ADULT"] is resident at my address. You say this is based on [THE COUNCIL'S STATED REASON — FOR EXAMPLE, A CREDIT REFERENCE RECORD / ELECTORAL REGISTER ENTRY / NO REPLY TO YOUR REVIEW FORM].

2. My grounds

I have been the only adult resident at this address since [DATE].

[NAME] lives at [THEIR ACTUAL ADDRESS] and has done since [DATE]. [EXPLAIN WHY THEIR NAME APPEARS AT YOUR ADDRESS — FOR EXAMPLE, OLD BANK ACCOUNT NOT UPDATED, POST STILL REDIRECTED].

( ) [NAME] lives with me but is disregarded because [FULL-TIME STUDENT / OTHER REASON], so the discount still applies under section 11(1)(b).

( ) I did not receive or could not return your review form because [REASON].

3. Evidence enclosed (copies)

[LIST — FOR EXAMPLE, THEIR TENANCY AGREEMENT OR COUNCIL TAX BILL AT THE OTHER ADDRESS; LETTER FROM THEM CONFIRMING WHERE THEY LIVE; STUDENT CERTIFICATE; ELECTORAL REGISTER UPDATE].

4. What I ask

Please reinstate the single person discount from [DATE], send a corrected bill and refund or credit any overpayment. If you do not agree, please give me your reasons in writing, as section 16(8) requires.

I understand that if you do not reply within 2 months, or I disagree with your reply, I may appeal to the Valuation Tribunal.

Yours faithfully,
