13th Month Pay Not Paid: DOLE Checklist

For rank-and-file workers. The employer must pay not later than 24 December. Worker: [Your name].

1. What you need

☐ Your name, address, phone, email and date of birth.

☐ Type of employment, date hired, nature of work and current status.

☐ Employer’s name, office address, contact person, number of workers and type of business.

☐ If agency-hired: the principal’s name, address and contact.

☐ What you already did inside the company, and any complaint filed elsewhere.

☐ Copies of your payslips, your computation and your letter. The form lists no attachments, so ask the officer what to show.

2. The form

– Request for Assistance, DOLE-SEnA Form 1.1. Tick “13th month Pay” and, as the result you want, “Payment of Money Claims”.

3. Your application

– Start with a written demand to your employer and keep proof it was received. Then state in the form the year, the amount and what you did.

4. Where to file

– Any DOLE office near where you live, or the NCMB, at the SEnA Desk.

– Online through DOLE ARMS, or by email. An officer speaks with you first, then the form is completed.

5. Time limits

– SEnA is a 30-day conciliation. Both sides can agree to add up to 7 days.

– If there is no settlement, the officer refers your claim to the office that handles it.

– Money claims must be filed within 3 years (Labor Code, Art. 306).

6. Keep it and renew

– Keep the form, any settlement and any referral.

– Labor Code, Art. 118 bars dismissing or discriminating against a worker for filing a complaint under its wage rules.
