Resigning? The 30-day notice, and when you can skip it

Thinking of leaving before the holidays β€” or right after? The Labor Code lets you resign without giving any reason. The one condition: a written notice served on the employer at least one (1) month in advance. Without it, the employer may hold you liable for damages.

Kailan pwedeng walang notice?

You may end the employment right away, without notice, for a just cause:

  • serious insult by the employer or its representative on your honor and person;
  • inhuman and unbearable treatment by the employer or its representative;
  • a crime or offense by the employer or its representative against you or an immediate member of your family;
  • other causes analogous to these.

Example: the dates, step by step

Illustrative example only.

Step Date Rule
Resignation letter received by HR (signed "received") Mon, Nov 9, 2026 written notice
Earliest effective last day Wed, Dec 9, 2026 at least one month in advance
COE requested in the same letter within 3 days of the request DOLE LA 06-20
Final pay released on or before Fri, Jan 8, 2027 30 days from separation, DOLE LA 06-20

⚠️ Tandaan. The notice has to be in writing and served on the employer. A chat message to your supervisor is easy to dispute. Hand it to HR and your supervisor, and keep a copy with a "received" signature, date and time β€” that copy is your proof that the month started.

Checklist bago mag-resign

  • ☐ Count one month from the day HR receives the letter β€” that is your earliest last day
  • ☐ Letter addressed to your supervisor, copy to HR, receiving copy kept
  • ☐ Handover list and company property ready for clearance
  • ☐ COE and final pay requested in the same letter
  • ☐ Leaving at once for a just cause? Write down the facts: dates, who, what happened
